FEDERLE. A telephone message Friday morning at 6 o’clock informed Coroner Dr. N.F. Bray of our city of the sudden death of William Federle, the 21 year old son of Joseph and Marie Dederle who reside near Newbern in Elsah Township, about 12 miles south of Jerseyville. He arose at the usual time in the morning and while the father was tending to his stock and investigating and rejoicing over the good rain we had, the mother, busy in her kitchen, was startled by the report of a shot. She went into the yard and found her son dead. A bullet wound below the heart told the story. The husband was summoned and finding the lifeless body of his son, sent word to Jerseyville. Dr. Bray, accompanied by Deputy Sheriff Ed Chappell and John Dunohy responded, The coroner impaneled a jury, composed of John Dunphy, foremam, Henry Camp, Ed Rintoul, Michael Michel, George and Fred Hendricks, who after examining father and mother, returned the verdict: Death due to gunshot wound inflicted by his own hands. The family is prostrated and unable to assign any motive for the rash act. For several days the young man had complained of headache and therefore it is presumed that the extreme heat of the previous days had prompted him to self destruction. It is evident the act was not premeditated as he had several social engagements, among them a fishing trip with Ray Glassbrenner of Alton for Sunday. The funeral was held Sunday afternoon at 2 o’clock from the home to the Melville Congregational church. Interment took place in the family lot in the adjoining church yard. On June 26 Fender was charged with aggravated assault for alleging causing bodily harm to his wife and violation of the domestic violence act. The Fenders were to have met informally at the Jersey County courthouse the afternoon of the shooting to work out details of a divorce, but according to her attorney, Fender’s attorney had been unable to reach him. Her attorney told the Democrat News that he had rescheduled the informal meeting for Thursday am. According to the account of the incident by Chief of Police Tom Woelfel, Fender was at the house of a friend on McGills t and had a gun, after Fender left the friend called the police. Patrolman Bill Bridges went to the home and Woelfel and Lt. Dale Ogden searched the area for Fender, with negative results. Woelfel said the police were then notified by radio that another call had been received and Fender was at the home of his estranged wife and had just kicked in the door. The police arrived just after the shooting and called the ambulance. A friend who was in the apartment with Mrs. Fender told police that after she called the police that she and her 6 year old child and Mrs. Fender ran down the hallway to a bedroom just as Fender kicked in the front door. She was in the process of chain locking the door to the bedroom when Fender broke in that door. The woman said she grabbed the barrel of the 22-caliber revolver and wrestled with him. When she realized she might be shot she ran out of the room and Mrs. Fender followed. Investigation revealed that Mrs. Fender was shot in the back as she ran down the hall. She threw up her hands and turned around and Fender shot her again in the head, she fell and he shot her once again at close range and then shot himself in the head and his body fell over hers. FERNS. Hon. Thomas F. Ferns, 62, former Jersey County judge and well known over southern Illinois as a jurist of great ability, passed away at his home in Springfield, Tuesday, October 3, 1922, after 8 years of illness. Hon. Thomas Francis Ferns was born in Jerseyville, July 27, 1862. He was the son of John & Hannah (Haysd) Ferns. His father, John Ferns, was a native of Trenton, NJ, and settled in Jersey County, in 1835. The early death of his father left Thomas without any means of support. Unaided, and with only the hope and advice of a true Irish mother, the boy struggled for an education—–through his own efforts, he worked—–through high school graduat— the Jerseyville high school, —-1882. Then in 1883, he entered the St. Louis law school, pursuing the same methods until he received his degree in June 1885. He was admitted to the bar in March previous to his graduation. He was elected and held the office of City Attorney for 3 consecutive terms from 1885-1891. Mr. Ferns was elected 3 successive terms to the Illinois General Assembly, serving in the House of Representatives from 1891-1895 inclusive. Thomas Ferns was one of the most brilliant lawyers that Jersey County ever produced. As a pleader before the bar, he was unequalled, and in ready wit, eloquence and unfailing memory, he was without a peer. He seldom lost a case and his services as a lawyer were constantly sought. He was a staunch Democrat. Mr. Ferns was married June 26, 1895, to Elizabeth C. White, of Springfield, IL. To them were born 5 children, Edith, now Mrs. Waynewright Ernst, of chicago, Thomas F. Jr., engaged in the automobile business in Springfield, Stephen White who was killed by lightening in June 1921, and Misses Elizabeth and Marian Ferns of Springfield. He is also survived by 1 sister, Miss Margaret Ferns, and 2 half brothers, William F. and David D. Fahey of this city. During the last years of their residence in Jersey County, the Ferns family lived on the farm east of Jerseyville, known as “Ferndale place” consisting of 240 acres and stocked with pedigreed polled durham cattle and poland china hogs. Mr. Ferns continued in active practice of law as well as managing his farm. In the spring of 1900, he became the owner of the Villinger Opera House and thoroughly remodeled the entire building, stage and scenery, providing Jerseyville with a first-class opera house. In the election of 1906, he was elected to the County judgeship. Resigning just before the close of his 4th yr, to move to Springfield, IL, where he engaged in the practice of law. He was later appointed Master in Chancery of Sangamon County and continued in this office until 2 years ago, when his failing health compelled him to resign all active duties. About 8 years ago, Judge Ferns though handicapped by physical infirmities and suffering, continued to perform his onerous duties, the brilliant mind of a great lawyer still functioned. The weight of his physical suffering compelled him to withdraw from public life. Death came as an angel of relief to his tired body. Funeral services were conducted from the Church of Immaculate Conception in Springfield. Rev. Father Timothy Hickey officiated at the requiem high mass. Burial was in the Catholic cemetery, beside the grave of his son, Stephen. Among those who went from here to attend his funeral are Mr. & Mrs. David Fahey, William F. Fahey and children, Mrs. A. F. Ely, Miss Lillie Shafer, and Judge W. T. Sun—(derland?) – incomplete.

FERNS. Stephen Ferns, 21, second son of Judge & Mrs. Thomas F. Ferns of Springfield, IL, formerly of Jerseyville, was killed instantly by a bolt of lightning near Auburn, IL, Monday afternoon. A companion, John Kelly, 21, a son of Mr. & Mrs. Frank Kelly of Springfield, was killed by the same bolt. The 2 boys, with 3 companions – Earl Friedmeyer, son of attorney John G. Friedmeyer, Paul Pennewitt, son of Mr. & Mrs. Penne witt, of 105 S. Grand Ave., west; and Robert Hunt, son of Mr. & Mrs. B. F. Hunt, of 823 S. Walnut St., Springfield, had planned to spend their summer vacation in hard work and were in the employ of the Alzin A Construction Co. which is building a stretch of hard road near Auburn. They had pitched a tent in a field near the cement house to rough it for the summer. “The distressing tragedy” which has caused great sorrow in Springfield”, says the State Journal, because of the fact the boys were well known among the younger people of Springfield and because their parents are well known in business and professional circles, occurred on the first day of what the boys had planned to be a summer of hard work. Stephen was a law student at Washington University, St. Louis, MO. Besides his parents, he leaves 1 brother, Thomas F. Ferns, Jr., and 3 sisters, misses Edith, Elizabeth and Marion Ferns. News of the tragedy reached Jerseyville Monday evening through a telephone message from Miss Edith to W. F. Fahey who departed this am for Springfield. His sister, Miss Margaret Ferns, a sister of Judge Thomas Ferns went to Springfield Tuesday am. When the lightning struck, the boys had just unloaded a truck of cement into the cement warehouse. It was raining, thundering and lightning. Ferns was standing in the door of the warehouse and kelly about 5 feet from the door. Hunt had just gone into the shed, Fried Mehyer and Pennewitt were standing near one end of the shed on the loading platform. According to Pennewitt, a sudden bolt of lightning struck with a deafening crash and a blinding flash. Kelly fell over in the cement dust on the platform and Ferns fell inside the door. Ferns’ companions tried to revive him by artificial respiration and a lungmotor arrived from Divernon within 15 minutes, but to no avail. Kelly is believed to have killed instantly, as was Ferns. The remains of the boys were taken to Vancel undertaking establishment in Auburn, and were brought to Springfield by Coroner C. T. Branson. Ernest Easley, foreman of the cement crew, and another workman were stunned by the bolt. A pair of pliers was knocked from Easley’s hand, and the other man’s hair was singed on the right side of his head when the bolt struck a pipe near which he was standing. Pennewitt, friend of the Ferns and Kelly, tells the following story of the tragedy in tuesday’s State Journal: “It happened about 2:15. We, that is to us 5 boys, “Steve” Kelley, Bob Hunt, Earl Friedmeyer and myself had just finished – incomplete

FEYERABEND. Also on file”— Mrs Iva Orf-feyerabend, wife of George L. Feyerabend, has brought suit for divorce in St. Louis, and the papers were served here Thursday on the defendant. Mrs. Feyerabend states in her complaint as follows: – plaintiff, who was Iva Orf, states that on 25 June, 1920, in the city of Clayton, County of St. Louis, State of MO, she was lawfully married to the defendant: that plaintiff continued to live with the defendant as his wife, from and after the day and year aforesaid, until 15 October 1921; that during all that time plaintiff faithfully demeaned herself and discharged all her duties as the wife of defendant, and at all times treated him with kindness and affection, but the defendant wholly disregarding his duties as the husband of plaintiff, has offered plaintiff with such indignities as to render her condition intolerable as the wife of defendant, in this, to-wit – that defendant exhibited a violent and uncontrollable temper towards plaintiff, used intoxicating liquors to excess and when under the influence thereof, and at other times, cursed and abused plaintiff, and threatened her; that defendant left plaintiff and their infant son in the city of St. Louis, on or about October 15, 1921, without any means of support, and told plaintiff they could remain here, he didn’t care, he had lived before and could live without plaintiff; that defendant would mock the birds in the presence of plaintiff and insisted that plaintiff also mock birds, and would become angry at her because she refused to do so; that defendant humiliated and annoyed plaintiff by instituting a replevin suit against her for the possession of certain furniture and household goods, belonging to her, and deprived her of the use thereof; that defendant caused plaintiff’s arrest and incarceration, in the city of St. Louis, without any cause whatsoever. Feyerabend of Jersey County has filed a petition in the county court of Jersey County praying that he be appointed administrator of the estate of his deceased brother, the late George L. Feyerabend, who died in a St. Louis hospital 22 Nov 1922, after a lingering illness of several months duration. Feyerabend sets forth in the petition that the said George L. Feyerabend was possessed of personal property to the amount of about $3,000, and that he left surviving him no widow or children, but that he did leave Henry M. Feyerabend, Sophia Louise Hoppe and Elizabeth Feyerabend, his brother and sister, as his only heirs at law. The petitioner sets forth also That Iva Orf, claiming to be the widow of George L. Feyerabend, is not his widow, in as much as she was supposed to have married Feyerabend about 25 June 1920, which was within a period of less that 1 year from the date that she obtained a divorce from her husband Tony Orf. As George L. Feyerabend was at that time a resident of Jerseyville, the marriage was contrary to the flaws of the state of Illinois and is therefore null and void. The petitioner also claims that Iva Orf, who claims to the Feyerabend’s widow, lived with Feyerabend for 2 years or more within the State of Illinois. It is also denied in the petition that George L. Feyerabend is the father of the child called by Iva Orf, George L. Feyerabend, Jr., now about 2 years of age. The case has not yet been set for hearing.
